Importers take note: changes to Biosecurity Act | June 2016

With the commencement of the new Biosecurity Act 2015 on 16 June 2016, importers are advised to take note of the new upcoming changes to import permits and the need of an import permit prior to the arrival of goods into Australia

With this new legislations has come changes to import conditions and an increase in selected goods or classes of goods that can be imported into Australia from 16th June 2016 without a “Permit to Import” being required and thus reduce restrictive documentary requirements.

Significantly there is a lot of fresh produce as well as used machinery & tyres, animal feeds, peat, dried plant material and certain plant and semi processed plant products no longer requiring a “Permit to Import” or had import conditions changed as from 16th June 2016.

Also a “Change of Practice “ has been made with regards to them processing a PERMIT TO IMPORT after a shipment has arrived –they will no longer do this so the primary concern now is

  • Import permits will be required prior to arrival of goods;
  • Under the Biosecurity Act 2015, the department cannot issue an import permit for goods that have already landed.
  • If the goods cannot be cleared under an existing BICON case without a permit requirement the goods will have to be re-exported or destroyed under DAWR supervision
